Deposition Know-How The biggest mistake made by lawyers and non-lawyers alike is taking depositions TOO EARLY!
All too often litigants take depositions before they know what the case is about, what the other side knows, what the other side has in the way of evidence, what the other side is going to argue ... things that can be easily discovered through the use of pre-trial interrogatories, requests for admissions, requests for production, and subpoenas of non-parties.
Since you usually have only one chance to depose someone (and it's the only time you'll be able to question them under oath before trial) it just makes sense to have a keen idea what they're going to say before you take their deposition ... and it's even better when you can hand them documents or tangible evidence and ask them, "I show you what's been marked Exhibit 4. Do you recognize it? Is that your signature at the bottom? When did you send this to the addressee? Who told you to send it? What else did they tell you?" See how it works? See the power in waiting to take depositions ... waiting until you have evidence in hand and a fairly good idea what the witness is going to say?
